Authorization Issues, Tonino Lamborghini vs Philippines' Globe Telecom

This has becoming more interesting especially that Tonino Lamborghini Group had replied to the Philippine mobile network company, Globe Telecom's statement over the authorization issue on using their trademark license.

We have posted this before entitled Globe Tattoo Tonino Lamborghini where we posted the start of the issue and Globe Telecom's reply.

Globe on their statement claimed that they are authorized by Primo Mobile, a Singapore based company that is according to them has a master license with Tonino Lamborghini s.r.l., which granted them the license to use the Lamborghini logo on their product.

It can be recalled that the Philippine mobile network company, Globe Telecom launched their USB stick and dubbed as Globe Tattoo Tonino Lamborghini, formerly named as Globe Visibility. Thier new launch USB stick was repackaged as Globe Tattoo Tonino Lamborghini and claimed a 10 mbps speed.

Tonino Lamborghini however publicly said the Globe Telecom had used their trademark without an authorization from their part which is a serious infringement. "Tonino Lamborghini s.r.l. has never manufactured or authorized anyone to manufacture such a product, which constitutes therefore a serious trademark infringement," an extract from their official statement.

Globe Telecom answered the issue and released this statement to dispel the license infringement accusation.

Globe Telecom obtained authorization to use the name and logo Tonino Lamborghini through an agreement with Primo Mobile, the master franchisor of mobile phone related products for the Italian brand Tonino Lamborghini. Primo Mobile is a Singapore-based company that has a master license agreement with Tonino Lamborghini s.r.l. and is duly authorized to sub-license the use of the Lamborghini logo. The design of the Globe Tattoo Tonino Lamborghini 4G USB sticks was reviewed and approved by Primo Mobile.

Globe Telecom assures the public of its strong adherence and commitment to the highest ethical standards in business and good corporate governance. The company will not engage in any activity that will mislead the public in the course of doing business and serving its customers.

Tonino Lamborghini however answered the Globe Telecom's claim on their facebook page.

Tonino Lamborghini Group wishes to clarify that Primo Mobile had been granted only a trademark license – neither a master license nor a master franchise – but such trademark license agreement was duly terminated by the licensor, Tonino Lamborghini s.r.l., some months ago. In any case, such trademark license agreement did not authorize Primo Mobile to sub-license the use of the Tonino Lamborghini trademark and logo.

This is really getting more interesting, I think that we should wait for Globe Telecom's next move. Though it is not clear on what would the Tonino Lamborghini will going to do right now, would their lawyers enter the scene to make any legal arrangements, like suing or whatever?

We, the keywordspeak.com team hopes that the issue will be resolve in the most peaceful way as soonest as possible. We will be updating this issue as soon as we heard any news regarding this controversy.
