Case filed against 'The Buzz' staffs - Copyright Infringement

ABS-CBN and GMA7 proved their hot rivalry again as GMA Network Inc filed an Copyright Infringement case against ABS-CBN's "The Buzz" show's staffs.

A resolution dated 2008 but released only early this month, March 2011, eight production staff of 'The Buzz' talk show were charged in court for violating the Republic Act 8293 or the Intellectual Property Code.

The case is all about The Buzz featured Jopay Paguia, a member of sexbomb dancers on their show. GMA accused the showbiz show of showing a scene from the soap opera Daisy Siete while featuring Jopay.

GMA Network Inc claimed that the unauthorized airing of scenes from "Daisy Siete" happened on the Feb. 13, 2005 show of The Buzz.

Assistant City Prosecutor Vesta Victoria Villamor, that the "The Buzz's" eight staff members had each episode a product of their meeting and intense brainstorming, and that there was no merit to their defense of ignorance.

In ABS-CBN's defense, the accuese said that they didn’t violate any copyright laws because the airing of the footage was just only for a few seconds and was intended as part of a report on current events, where Daisy Siete was a part.

The respondents added that under the Intellectual Property Code’s Article 185, the reproduction of a material has been allowed under the "Fair Use" principle.

This is really another clash between the two rival networks that will add to their long list of court cases.
